1. Governing law and jurisdiction
This Agreement and any disputes arising hereunder shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict-of-law provisions. Any legal action or proceeding shall be brought exclusively in the state or federal courts located in Clark County, Washington.
2. Payment terms
Full payment and cleared funds are required prior to dispatch or release of any trailer. PrimeLoad Trailers reserves the right to withhold shipment until payment has been fully received and verified.
Accepted payment methods include bank wire and major credit/debit cards. Specific accepted methods are confirmed at checkout.
3. Order acceptance and cancellation
All orders are subject to acceptance and inventory availability. PrimeLoad Trailers reserves the right to:
- Cancel orders due to inventory shortages
- Correct pricing or typographical errors
- Cancel transactions resulting from technical or system errors
If we cancel an order, a full refund is issued to the original payment method.
4. Pricing and website accuracy
While we work to keep pricing, descriptions, and availability accurate, errors can occur. PrimeLoad Trailers reserves the right to correct errors and update information at any time without prior notice.
5. Limitation of liability
To the fullest extent permitted by law, PrimeLoad Trailers’ total liability arising from any sale shall not exceed the purchase price paid for the trailer. We shall not be liable for indirect, incidental, special, or consequential damages, including but not limited to:
- Loss of business or income
- Equipment downtime
- Towing-related issues attributable to customer setup or usage
- Damage caused by improper or unauthorized use
6. Customer responsibilities
The buyer is responsible for:
- Verifying tow vehicle compatibility (hitch class, GVWR, towing capacity)
- Compliance with all federal, state, and local transportation laws
- Proper weight distribution and load limits
- Securing required permits, registrations, and insurance
Improper towing, overloading, or misuse voids warranty protections and disclaims liability.
7. Title, registration, and taxes
The buyer is responsible for:
- State registration and titling
- Applicable sales and use taxes
- DMV filing requirements in the buyer’s state
PrimeLoad Trailers is not responsible for state-specific registration procedures beyond providing required documentation.
8. Risk of loss
Risk of loss transfers to the buyer upon delivery and acceptance of the trailer.
9. Electronic communications
By using this website, you agree that electronic communications, contracts, and signatures are legally binding and satisfy any legal requirement for written communication.
10. Website use
You agree not to:
- Misuse or attempt unauthorized access to the website
- Copy, scrape, or reproduce content without written permission
- Engage in fraudulent or unlawful activity
PrimeLoad Trailers reserves the right to restrict access or pursue legal remedies for misuse.
11. Dispute resolution
Customers and PrimeLoad Trailers agree to first attempt to resolve any dispute informally by contacting sales@primeloadtrailers.com. If informal resolution is not successful within 30 days of the initial contact, either party may pursue resolution through the courts of Washington State as set forth in Section 1 above.
12. Changes to these terms
We may update these Terms from time to time. The “Last updated” date at the top reflects the most recent change. Continued use of the website after a change constitutes acceptance of the revised Terms.
